Terms and Conditions
Please carefully read the following Terms and Conditions, including the Non-Disclosure Agreement (NDA), before submitting any property for listing or making information inquiries through the contact form provided by Promethean by Aurora Borealis. By submitting the form, you agree to be bound by these Terms and Conditions.
Listing and Submission
a. By submitting a property for listing through our contact form, you acknowledge and agree that Promethean by Aurora Borealis will not initiate any sales process or take any action to market or sell the property until after contacting you (the submitter) for further discussion.
b. Promethean by Aurora Borealis reserves the right to review and evaluate the submitted property based on our internal criteria and guidelines before proceeding with any listing or sales activities. We may decline or delay the listing of a property at our discretion.
c. Additionally, it may be necessary for us to visit the property for further assessment and evaluation purposes.
Additional Information Requirement
a. By submitting a property for listing, you acknowledge and agree that Promethean by Aurora Borealis may require additional information to evaluate the property. This information may include, but is not limited to, photos, location details, performance reports, and any other relevant information.
b. Promethean by Aurora Borealis may directly contact you or arrange meetings, including physical and online discussions, to gather the necessary information for the property evaluation process.
c. In some cases, Promethean by Aurora Borealis may request proofs or documentation to establish that the submitter is either the owner of the property or is officially and rightfully permitted to list the property on behalf of the owner.
Privacy and Confidentiality
a. We respect your privacy and are committed to protecting the confidentiality of your personal information. By submitting the contact form, you understand and agree that Promethean by Aurora Borealis will not share your contact details or disclose your identity without your explicit consent.
b. Promethean by Aurora Borealis may collect and store your personal information provided in the contact form for the purpose of communicating with you regarding your submitted property and other relevant real estate matters. Please refer to our Privacy Policy for more details on how we handle and protect your personal information.
Non-Disclosure Agreement
a. All information provided by Promethean by Aurora Borealis, including property details, pricing, communications, and any other related information, is considered confidential and proprietary.
b. For information inquirers: You agree to keep all such information strictly confidential and shall not disclose, share, or provide access to any third party without Promethean by Aurora Borealis' express written consent, except as required by law.
c. For property listers: You acknowledge and agree that any correspondences, discussions, or communications exchanged between you and Promethean by Aurora Borealis, including but not limited to emails and meetings, are strictly confidential. You shall not share or disclose such correspondences to any third party without the explicit consent and approval of Promethean by Aurora Borealis.
d. Both information inquirers and property listers shall ensure that their employees, agents, or any other individuals involved in the property inquiry process adhere to the same confidentiality obligations.
Limitation of Liability
a. While Promethean by Aurora Borealis strives to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any content or information provided through our contact form. You acknowledge and agree that any reliance on such information is at your own risk.
b. Promethean by Aurora Borealis shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use of our contact form, including but not limited to property listings, communications, or any actions taken or not taken based on the information provided.
Dispute Resolution
a. Any disputes arising from or related to these Terms and Conditions, including the NDA, shall be subject to the laws of the United Arab Emirates (UAE) and the exclusive jurisdiction of the courts in Dubai, UAE. However, it is acknowledged that disputes may also involve the laws and courts of the countries where the information inquirer or property lister is located or operating from.
b. Both parties acknowledge the importance of good faith negotiations in the amicable resolution of any disputes arising from or related to these Terms and Conditions, including the NDA. In the event that a mutually agreeable resolution cannot be reached, either party shall be entitled to pursue legal remedies in accordance with the applicable laws and jurisdictions, including the possibility of initiating legal proceedings in other countries where the information inquirer or property lister is situated or conducts business. It is understood, however, that the primary jurisdiction for the resolution of disputes shall be the United Arab Emirates (UAE) and the courts located in Dubai.
Modification and Termination
a. Promethean by Aurora Borealis reserves the right to modify or amend these Terms and Conditions, including the NDA, at any time, without prior notice. Any changes to the Terms and Conditions will be effective immediately upon posting the updated version on our website. It is your responsibility to review the Terms and Conditions periodically.
b. Promethean by Aurora Borealis may terminate or suspend the availability of our contact form, including property listing services, at any time, for any reason, without liability to you or any third party.
By submitting the contact form, you confirm that you have read, understood, and agreed to these Terms and Conditions, including the NDA. If you do not agree to these Terms and Conditions, please refrain from submitting the form.
